As a US citizen, I need to be careful to track the days I am in the Schengen Zone and, if possible, get a passport stamp when I leave (to stop the clock).  I will be motoring through the Kiel Canal and would like to get an official stamp in Cuxhaven that proved I left.  Anyone know if that is possible and how?  I have a list of Schengen zone border cross points and Cuxhaven is listed; however, where and how is a mystery.  Any ideas?  Any German locals out there that may have experience?

Hi Dave,
at Cuxhaven you can go to the customs (Zoll) which are located quite a while by walking from the yacht harbour. They are open only monday to friday from 8 a.m. to 4 p.m.

Why don't you ask for the stamp before you leave the Kiel Canal? The Zoll is directly before the locks in Brunsbüttel on the south side of the canal and is open 24/7

Thanks, that is great information!  I would not have known without your comment.  I want to get a stamp in my passport just to prove I was heading off shore.  The locks will make that easy.  I assume there is a pier to which to tie up a 50 foot boat?

as far as I remember there is a big pier for commercial ships. You can call the customs as well on phone (+49 4852 83000) or on mobile phone (+49 173 211 3657).

Can confirm in Brunsbutel there is a small marina on the north side that you can tie up also a fuel station, easily accommodate a little 50ft yacht.
Do not forget that if you are sailing with AIS , the authorities will know where you are.
If sailing in territorial waters down the north sea it could be argued you are not offshore.
Presuming you leave Kiel and go straight to Gibralter you could argue you are offshore; but if you go Brunsbutel to say Le Harve, that does not count.
Your destination from Germany needs to be outside the Shengen Zone.

The UK is outside the Shengen but inside the EU , so if trying to prove for tax you are offshore that does not count.

Sailing , what I guess is a US flagged boat in europe, the customs will take an interest in you, northern europe should not be a problem ; but the Med they will be keen to collect a bit of extra revenue.

Your other option would be to leave Schengen area at the island Helgoland, very big Harbour, worth a Visit. It is about 3 hours past Cuxhaven in the open North Sea. Good thing for Helgoland is that you may leave at any time without considering the tide while you must leave Cuxhaven or Brunsbuettel only at high tide, currents are pretty strong. And don't pass the area at strong wind against current- that might be very dangerous.

As explained before however if you continue your sail with stops in The Neterlands, Belgium or France you will not leave Schengen, so will have to get your exit stamp at the very last customs (= Zoll) office of your final Schengen departure country.

Dave, do I assume that you sailed your 505 to Northern Europe? I also have a 505 and am hoping to sail to UK from Newport, RI next June (2018). Could you brief me on your trip across. You could also reply direct to me at steve@mcinnislaw.com

Steve:  I did not take the Hanse to Europe.  It is still in California.  I picked up a new Swan 54 in Finland and am currently getting her to the med.

Hi,

Just a word of caution. The Schengen rules are complicated and there are almost no loopholes. In southern Europe, you have to leave the area completely and you could go to either Morocco, Turkey or Gibraltar.

In Northern Europe, it is England and the Channel Islands which are outside Schengen. I would investigate furter if visiting them would freeze and/or reset the allowed Schengen periode.


Another point to consider is that VAT taxation and the Schengen area rules are not regulated in the same manner. In other words, you can be liable for VAT even if you have complied with the Schengen rules.

Thanks to all for the advice. I ended up hiring an attorney in Belgium.
Bottom line from them is (1) days 12 miles off shore don't count and (2) there is no reset for leaving the Zone. It is 90 days in every 180. It is also true that Schengen and VAT are completely unrelated. In my case Swan exported the boat and we sailed her to Helgoland where it was officially imported. Swan then ran the paperwork back through Finish customs to complete the export. I should be good to remain in the EU until I sail the ARC. Sure was a lot more work than buying my 505 which is sitting at it berth in California.
